Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Rota mobile application and website (https://rota-app.com) operated by Luminis Lojistik Teknoloji Ticaret Danışmanlık Hizmetleri Limited Şirketi ("Company", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Service description

Rota is a business-to-business (B2B) workforce management platform that provides scheduling, attendance tracking, leave management, and related features. The Service is provided to organizations ("Employers") who subscribe to Rota, and to their employees ("Users") who are invited to use the platform by their Employer.

2. Account registration

To use the Service, you must create an account using the credentials provided by your Employer or through our registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3. Acceptable use

You agree to use the Service only for its intended purpose. You shall not:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use the Service to transmit malicious code, spam, or harmful content.
  • Share your account credentials with any other person.

4. Employer responsibilities

Employers who subscribe to the Service are responsible for ensuring that their use of workforce data complies with applicable employment laws, data protection regulations, and their own internal policies. Employers are responsible for informing their employees about the use of the Service and obtaining any required consents.

5. Intellectual property

All content, features, and functionality of the Service, including text, graphics, logos, icons, software, and the Rota brand, are the exclusive property of the Company or its licensors and are protected by intellectual property laws.

6. Data and privacy

Your use of the Service is subject to our Privacy Policy, available at https://rota-app.com/legal/privacy/en (English) and https://rota-app.com/legal/privacy/tr (Turkish).

7. Service availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

8. Account deletion

You may request deletion of your account at any time through the app settings or by contacting us at support@rota-app.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

9. Limitation of liability

To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability shall not exceed the amount paid by your Employer for the Service in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses arising from your violation of these Terms or misuse of the Service.

11. Termination

We may suspend or terminate your access for violation of these Terms. Your Employer may also terminate your access per their subscription agreement. Upon termination, your right to use the Service ceases immediately.

12. Governing law

These Terms shall be governed by the laws of the Republic of Turkey. Disputes shall be resolved exclusively by the courts of Istanbul, Turkey.

13. General provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
  • No waiver: The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms or your rights hereunder without the Company's prior written consent. The Company may assign these Terms without restriction.

14. Changes

We may update these Terms from time to time. Continued use after changes constitutes acceptance.
